The effects of law on the quality of the environment are often discussed in a roundabout way in doctrinal discourses. However, this question is not dealt with in a very methodical way, which raises the question of the interest, for lawyers, to adopt a proper approach for assessing the impact of the law. Rather than sticking to clichés about the effectiveness of environmental law, it is important to draw on existing scientific work whose purpose is to assess the impact of environmental law. Thus, it becomes clear that considerations about the alleged ineffectiveness of environmental law are more a matter of value judgement than of factual judgement. But beyond taking an interest in such studies, it might be even more fruitful for lawyers to become involved in the production of such knowledge themselves by adopting an “empirical approach of environmental law” (AEDE).
